Cari Marino litigates and negotiates cases nationwide for clients ranging from individuals to Fortune 100 companies. Whether defending a manufacturer against product liability allegations, advising an employer on potential litigation risk, or pursuing multimillion dollar breach of contract claims arising out of an international transaction, she listens to her clients’ objectives and then implements strategies specifically tailored to achieve those goals as efficiently as possible. While many of Cari’s clients look to her to negotiate resolutions, even bringing her in to take over negotiations where others have been unsuccessful, she is no stranger to the courtroom and regularly litigates in state and federal courts across the country. Cari has particular expertise in developing corporate representatives and preparing witnesses to testify; her commitment to establishing good working relationships with key fact witnesses enables her to better identify strengths and risks as well as ensure each testifying witness feels well prepared and supported at deposition and trial.
Commercial Litigation and Disputes

Cari handles complex commercial matters in state and federal courts nationwide. Current and past
matters include:

  • Representation of a Global 500 chemical company in a breach of contract action brought against its service provider in the Northern District of Ohio;
  • Representation of a publicly-traded pump manufacturer in an international arbitration involving breach of contract claims and counterclaims arising out of a large-scale project in the Middle East;
  • Defense of a real estate development company in a partnership distribution dispute related to underlying construction defect allegations in New York Supreme Court;
  • Representation of an automotive refinish product manufacturer as its national counsel in state and federal breach of contract actions in over 30 jurisdictions;
  • Defense of a chemical company and its European affiliates in a breach of contract action in the Middle District of Georgia arising out of negotiations for the purchase of a mining and chemical processing facility;
  • Representation of a nonparty law firm in connection with subpoenas issued in a multibillion-dollar RICO action in the Southern District of New York;
  • Defense of a welding equipment manufacturer against breach of contract and warranty claims in the Western District of Pennsylvania;
  • Representation of an aluminum manufacturer in connection with various commercial disputes and employment-related issues; and
  • Defense of an equipment manufacturer and its distributor in a breach of contract action in Kansas relating to underground oil drilling operations.
Products Liability Litigation

For almost 20 years, Cari has defended manufacturers against products liability claims ranging from
explosions, fires, and catastrophic injury to toxic exposures. Matters she has handled include:

  • Defense of an equipment manufacturer from case inception through trial as part of a national coordinating counsel team handling ongoing asbestos litigation in state and federal courts;
  • Representation of various equipment and appliance manufacturers at destructive testing and laboratory analysis in connection with fire causation investigations;
  • National settlement negotiator for equipment and chemical manufacturer clients in asbestos litigation;
  • Representation of a luxury recreational vehicle manufacturer in an arbitration alleging state Lemon Law claims;
  • Defense of an equipment component manufacturer in a federal case alleging severe personal injuries arising out of the alleged malfunction of stunt equipment on a movie set; and
  • Defense of a major appliance manufacturer in a variety of personal injury and property damage matters in state and federal courts
State Dealer Protection Statute Issues
Cari has substantial experience counseling clients on both litigation and non-litigation issues relating to state dealer protection statutes. In addition to regularly advising clients on the details and nuances of each state’s laws governing relationships between manufacturers and their distributors, she has also defended a publicly-traded manufacturing corporation, including successfully setting aside a $4 million default judgment and vacating the underlying entry of default, in a federal action alleging breach of state dealer protection statutes.
Securities Litigation and Regulatory Investigations

Cari began her legal career as a securities litigator and continues to advise various financial institution clients in connection with regulatory investigations and compliance matters.
