David Paul is a creative litigator with sophisticated litigation experience. He is a dynamic courtroom advocate who has taken and defended numerous depositions, including those of expert witnesses and corporate representatives. He has successfully represented institutional clients and individuals in product liability claims, securities litigations, employment matters, and complex commercial disputes.

Product Liability/Toxic Tort

David defends a precision equipment manufacturer as part of the Firm's national coordinating counsel role in asbestos product liability cases. He also assists the national trial team in trials across the country. In addition, David has represented a major appliance manufacturer in a variety of product liability cases. Prior to joining Leader & Berkon, David was involved in the national defense of Merck in the Vioxx pharmaceutical litigation.

Commercial/Securities Litigation

Recently, David assisted in the prevention of attachment of contract rights related to the sale of $20 million of liquefied natural gas, which allowed much needed delivery of the gas to the Republic of Argentina. On behalf of a prominent investment bank, David was involved in brokering a favorable multiparty resolution of a dispute over a series of complex bond transactions involving five major financial institutions. He also played a key role in the Firm's successful dismissal of a commercial claim brought against a major broker-dealer by a company who assumed the accounts of an electronic communications network used to execute stock transactions. Previously, David was part of the team achieving a favorable result in a multi-district securities litigation involving a billion dollar investment portfolio.

Creative Solutions

David applies creative and cost-effective strategies to the cases he handles. Last year, as part of the Firm's representation of a South African company that manufactures and sells tankers, David helped devise a plan to exchange documents with defendants and discuss resolution before engaging in a formal, more expensive, discovery process, which ultimately resulted in a favorable settlement. On behalf of a jet fuel supplier, David obtained a temporary restraining order against a debtor, seizing its bank account and airplanes, and forcing an attachment hearing, which resulted in a positive settlement of a breach of contract dispute.
